Winslow Farm Community Architectural Committees:
Every homeowner in Winslow Farm is a member of the
Winslow Farm Community Association, Inc., and another “organization.” It
may be a “condo association,” or a less defined “neighborhood committee” to
oversee the homes.
In 5 neighborhoods, Bent Tree, New Bent Tree, Laurelwood, Sweetbriar and
Olde Mill, each neighborhoods's covenants define these “Architectural
Control Committees” and their powers.
Members of neighborhood architectural committees meet when homeowners
request changes to property (fence) or have an issue with a neighbor violating
a rule.

We are in need of additional homeowners to volunteer their time on a
committee that currently lacks 3 members.
If you live in one of the neighborhoods not fully represented and want
to be an active homeowner, please call our property manager, Carole Damon
at 331-9095.
Here are notes from the “New Bent Tree at Winslow Farm” documents: (most
other neighborhoods would be similar)
Section 1.2 of the New Bent Tree Covenants defines “New Bent Tree
Committee” as the “Architectural Control Committee”The name of the
development is New Bent Tree at Winslow Farm. The effect on Owners (and
future owners) is to acknowledge the powers of the “New Bent Tree
Committee”. Houses have minimum size restrictions, maximum height
restrictions, 2 car garage requirements, 10 feet driveways of concrete or
asphalt, setbacks for permanent structures. No solar device, except ones
“flush with roofline”, are allowed. Replacement of light fixtures,
basketball goals, mailboxes, etc. must have prior written approval of “New
Bent Tree Committee”. Windows, gutters & downspouts will be factory
painted, no raw aluminum windows, all roof pitches will be 4:12, no metal,
fiberglass awnings or patio covers permitted, no aboveground swimming
pools. No addition or alterations to buildings without prior written
permission from “New Bent Tree Committee”. If the committee fails to act on
approval in 30 days, and no suit to enjoin construction commenced, no
approval is required of a project in New Bent Tree. Requests to the “New
Bent Tree Committee” require drawings to scale of 1 inch per 10 ft.
The committee may refuse permission to remove trees, repaint, construct,
etc when: plans are inadequate, improvement violates declaration, color
scheme is not in harmony, or...the proposed improvement is contrary to the
interests of other owners. All findings of “New Bent Tree Committee” are to
be given in writing to owner within 15 days. All streets were dedicated to
the public, all utilities are underground, and there are perpetual drainage
easements.
The committee consists of 3 owners. Committee members may be changed by
written approval of 2/3 of owners in NBT or vacancy can be filled by
appointment of owner by 2 remaining members of “New Bent Tree Committee”.
All lots in NBT must be maintained at all times and not be unsightly. This
includes: mowing grass & good husbandry with respect to all
landscaping, remove all debris & rubbish, cut down, remove dead trees,
keep exterior from becoming unsightly, maintain tree plot between sidewalk
& street or curb. Enforcement: If owner fails to cure (violations)
after 30 days written notice by “New Bent Tree Committee”, any owner in New
Bent Tree shall have the right to commence judicial proceedings. If owner
fails to abate violation, & failure threatens to cause immediate harm
to other property, “New Bent Tree Committee” shall have the right to enter
and correct. All legal costs shall be payable by defaulting owner. Each
owner in New Bent Tree is subject to Winslow Farm Declaration.
So, neighbors, what does this mean???
The good (or bad) news is that currently there is no enforcement wording
in any of the documents other than “any owner shall have the right to
commence judicial proceedings”.
New Bent Tree and/or Winslow Farm does not have enforcement power.
Only you or your neighbor can enforce the “rules”.
